Unfair Competition: the Umbrella Tort
In most states, “unfair competition” is an umbrella tort for all causes of action arising out of some illegal or tortious conduct by a defendant business that interfered with the plaintiff’s ability to conduct its business.
Examples of tortious conduct giving rise to an unfair competition claim include but are not limited to misappropriation of trade secrets; misappropriation of the plaintiff’s time, labor and skill; engaging in piracy or selling products that facilitate third party piracy; breach of a confidential relationship; dishonesty; false or misleading advertising; commercial defamation; trademark infringement; and tortious interference with existing or prospective business relations.
